[COVID-19] HR policy - Temporary guidance for processing criminal background checks and the starting date of new hires

COVID-19 continues to disrupt our Criminal Background Check vendor's operations and delaying the completion of CBCs. This guidance is to provide supervisors with information on when a new employee may begin work.

Who this policy applies to:
All employees, some student help positions, and volunteers.


Rationale:

COVID-19 continues to disrupt our Criminal Background Check vendor's operations and delaying the completion of CBCs.  This guidance is to provide supervisors with information on when a new employee may begin work. 


Policy Detail:

Regent Policy Document 20-19 policy allows for an offer of employment to be extended prior to the completion of a CBC, as long as the offer is contingent upon the successful completion of a CBC. 

 

Thus, the following steps are suggested:

  1. If the new hire is a regular employee (limited, faculty, academic staff, university staff - in part and full-time positions), then make the employment offer contingent upon the successful completion of the background check and allow the employee to start working pending the receipt of the completed background check from the vendor.
  2. If the new hire is an individual in a “position of trust” (in any of the classifications listed above) as defined by the Regent policy, then extend the offer of employment contingent upon the successful completion of the background check, but do not allow the employee to begin working until the completed background check has been received, unless some kind of emergency situation exists.
  3. Finally, our criminal background check vendor will complete background checks for those returned to you incomplete as soon as source data becomes available. The vendor will consult with you at that time to discuss next steps to complete the process including the requirement to notify the impacted employee that the subsequent check will be conducted.

In all cases, supervisors and chairs must consult Human Resources to ensure applicability with this guidance and with UW System and UW-La Crosse policy.
